Class Action Filed Against Citizens Property Insurance Corporation


Managed Repair Program Alleged to be Unconstitutional


Coral Gables, FL:  Middagh Law, P.L.L.C., today, announces the filing of a Class Action against Citizens Property Insurance Corporation, Citizens’ Board of Governors, Florida Office of Insurance Regulation, Florida Financial Services Commission and Florida Department of Financial Services. The State of Florida and its entities are alleged to be violating a property owner’s right to maintain their property as they wish and their right and freedom to contract with whomever they wish to perform repairs after a water loss as allowed under Florida’s Constitution.

This action comes in the wake of Citizens’ policy changes and the creation of the Managed Repair Program in 2018, which includes:


• $10,000.00 limit on water damage repairs unless the homeowners or business owners allow the State of Florida and its entities to determine what is damaged in your property and to be in charge of the repairs without the homeowner’s or business owners being able to contest or object. 

• The main objective stated by the State is to limit homeowners’ and business owners' ability to hire representation after a water loss, which then only allows the State to determine your damages and repairs.
